Terms of Use

1. Acceptance of Terms

By accessing, downloading, installing, purchasing, or using PoeEnhancer ("the Service", "the Software", "we", "us"), you ("the User", "you") agree to be bound by these Terms of Use in full. If you do not agree to every provision, you must not use the Service and must uninstall any related software immediately.

Your continued use of the Service constitutes ongoing acceptance of these Terms, including any future changes.

2. No Affiliation; Independent Tool

PoeEnhancer is an independent third-party tool. It is not affiliated with, endorsed by, sponsored by, approved by, or connected to Grinding Gear Games (GGG), Path of Exile, Path of Exile 2, or any related company, trademark, or brand in any way.

All game names, trademarks, and assets belong to their respective owners. References to Path of Exile exist solely for descriptive purposes.

3. Nature of the Service

The Service may modify local game client files on your device for cosmetic and/or client-side purposes. You acknowledge that:

  • You alone choose to use, install, and run the Software
  • You alone decide whether such use complies with any third-party terms, including GGG's Terms of Service and Acceptable Use policies
  • We do not force, require, or guarantee any particular game outcome, account status, or visual result
  • Game updates, patches, anticheat systems, or other third-party changes may break the Service at any time without notice

4. Use Entirely at Your Own Risk

You use the Service entirely at your own risk. To the maximum extent permitted by law, we have no responsibility and accept no liability for anything that happens as a result of your use or inability to use the Service.

Without limitation, this includes:

  • Game account warnings, suspensions, bans, wipes, or other enforcement actions
  • Loss of progress, items, currency, MTX, or any in-game value
  • Corruption, deletion, or modification of game files or other data on your device
  • Crashes, instability, performance issues, or hardware/software damage
  • Downtime, broken features, missing updates, or discontinuation of the Service
  • Chargebacks, payment disputes, or financial losses of any kind
  • Any claim, investigation, or dispute involving you and a third party (including GGG)

If using this tool may violate third-party rules, that is solely your decision and your risk. We are not a party to any dispute between you and GGG or any other third party.

5. No Warranty

THE SERVICE IS PROVIDED "AS IS", "AS AVAILABLE", AND WITH ALL FAULTS, WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

We specifically disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and uninterrupted or error-free operation.

We do not warrant that the Service will work today, tomorrow, after a game patch, on your system, with your account, or for any purpose you intend. Support, if any, is provided at our sole discretion and creates no obligation.

6. Complete Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POEENHANCER, ITS OPERATORS, OWNERS, CONTRIBUTORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY CLAIM, DAMAGE, OR LOSS WHATSOEVER ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS — WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE.

This exclusion covers direct, indirect, incidental, special, consequential, exemplary, and punitive damages, and any loss of data, profits, goodwill, account access, or business opportunity.

IF LIABILITY CANNOT BE FULLY EXCLUDED UNDER APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE LESSER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THIRTY (30) DAYS BEFORE THE CLAIM AROSE, OR (B) ZERO IF YOU PAID NOTHING.

Some jurisdictions do not allow certain exclusions; in that case, the above limitations apply to the fullest extent permitted.

7. Indemnification

You agree to defend, indemnify, and hold harmless PoeEnhancer and its operators, owners, contributors, and service providers from and against any and all claims, demands, actions, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights or terms (including GGG)
  • Any account action, ban, or dispute involving your game account
  • Any content, files, or modifications you apply using the Service

8. Accounts and Subscriptions

You are solely responsible for safeguarding your credentials and subscription keys. Keys and access are personal, non-transferable, and may not be shared, sold, rented, or redistributed.

We may suspend, revoke, or terminate access at any time, with or without notice, for any reason or no reason, including suspected abuse, chargebacks, fraud, or Terms violations. No compensation is owed for suspension or termination.

9. Refund Policy

All purchases are final. No refunds will be issued under any circumstances.

By completing a purchase, you acknowledge and agree that:

  • All sales of subscription keys and access are non-refundable
  • No partial, full, or prorated refunds are available for any reason, including dissatisfaction, non-use, game updates, bans, broken features, or inability to use the Service
  • Any technical help we provide is discretionary and does not create a right to a refund
  • Chargebacks or payment disputes initiated without first contacting support may result in immediate and permanent account termination and denial of future access

By purchasing, you expressly waive any refund claim to the fullest extent permitted by law.

10. Prohibited Conduct

You agree not to:

  • Reverse engineer, decompile, or disassemble the Software except where mandatory law prohibits this restriction
  • Redistribute, resell, lease, or share your subscription, keys, or account
  • Use the Service for any unlawful purpose
  • Attempt unauthorized access to any system, account, data, or infrastructure related to the Service
  • Interfere with, disrupt, overload, or abuse the Service
  • Circumvent access controls, licensing, rate limits, or security measures

11. No Obligation to Provide or Continue the Service

We have no obligation to provide, maintain, update, host, support, or continue the Service. We may modify, suspend, or permanently discontinue any part of the Service at any time without notice and without liability or refund.

12. Termination

We may terminate or suspend your access at any time, without notice, for any reason or no reason. Upon termination, your right to use the Service ends immediately. Sections intended to survive (including risk assumption, disclaimers, limitation of liability, indemnification, and refunds) shall survive termination.

13. Changes to Terms

We may change these Terms at any time by posting an updated version. Continued use after changes means you accept the new Terms. If you do not agree, stop using the Service.

14. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.

15. Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Service and supersede any prior understandings on this subject. No waiver is effective unless in writing.
